Terms of Use

1. Acceptance

By downloading, installing, or using Spudy ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. Service Description

Spudy is a productivity app that helps you build better habits and manage screen time. The App provides:

• Focus timers (Pomodoro, Deep Work, Detox, and Custom modes).
• Habit tracking with daily goals and streaks.
• App blocking — selected apps are blocked until you complete your goals.
• Gamified Photo Quests using on-device camera processing.
• A gems system earned through focus sessions and completed habits.

An active subscription and Screen Time permissions are required for full functionality.

3. No Account Needed

Everything is stored on your device. No sign-up, no login, no password required.

4. Subscriptions

4.1 Requirement

An active subscription is required to access all features. Weekly and yearly plans are available.

4.2 Billing

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Renewal is charged within 24 hours before the current period ends, at the same price.

4.3 Management & Cancellation

• Manage subscriptions in iOS Settings > Your Name > Subscriptions.
• Cancellation takes effect at the end of the current billing period.
• No refunds for unused portions of a subscription period.
• When a subscription expires, app blocking features will be disabled.

4.4 Free Trial

Any unused portion of a free trial is forfeited when you purchase a subscription. After the trial expires, continued use requires a subscription.

4.5 Refunds

All purchases are processed by Apple. Refund requests must be made through Apple — not through us. All purchases are final unless Apple's refund policy permits otherwise.

5. Screen Time Usage

By granting Screen Time access (FamilyControls), you acknowledge that:

• The App can block selected apps on your device.
• Apps are unlocked by completing habits, focus sessions, or by spending gems.
• We are not responsible for missed notifications or messages from blocked apps.
• You can revoke access at any time in iOS Settings > Screen Time.

6. Camera & Photo Library

By granting camera access, you acknowledge that:

• The camera is used for Photo Quests with on-device Vision processing only.
• No images or video are uploaded, transmitted, or stored beyond the current session.
• Photo Library access is used solely to save focus session summaries at your request.
• You can revoke access at any time in iOS Settings > Privacy & Security.

7. User Responsibilities

You agree to:

• Use the App in accordance with all applicable laws.
• Not attempt to circumvent app blocking through unauthorized methods.
• Not reverse-engineer, decompile, or exploit bugs in the App.
• Ensure minors have parental or guardian consent before using Screen Time features.

We may restrict access for violations of these Terms.

8. Age Requirements

The App is rated 4+ on the App Store. Parents and guardians are responsible for supervising use by minors.

9. Third-Party Services

No data is sold. No ads are displayed.

10. Disclaimer of Warranties

The App is provided "as is" with no warranties of any kind. We do not guarantee that:

• The App will be available without interruption.
• The App will meet your specific requirements.
• App blocking will work in every scenario or device configuration.

11. Limitation of Liability

We are not liable for:

• Indirect, incidental, or consequential damages.
• Loss of data or productivity.
• Damages resulting from blocked app access.

Our total liability shall not exceed the amount you paid for the App in the preceding 12 months.

12. Intellectual Property

Spudy owns the App, including its design, code, and content, all of which are protected by intellectual property law. You may not copy, modify, or distribute any part of the App.

13. Termination

We may terminate or suspend your access to the App for violations of these Terms. Upon termination, your right to use the App ends immediately.

14. Changes

We may modify these Terms at any time. Continued use of the App after changes are posted constitutes acceptance. Material changes will be communicated within the App.

15. Governing Law

These Terms are governed by Spanish law. Disputes shall be resolved in Spanish courts. EU consumers retain their rights under their country's consumer protection laws.

16. Apple App Store Terms

In accordance with Apple's requirements:

• These Terms are between you and Spudy, not Apple.
• Apple has no responsibility for the App or its content.
• Apple has no obligation to provide maintenance or support.
• Apple is not responsible for any claims related to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms.
